A federal judge has already found that the NSL statute is unconstitutional, but the government appealed the ruling. In an amicus brief filed Wednesday, EFF and the National Security Archive argue that the excessive secrecy surrounding the use of NSLs undermines government accountability and enables widespread misuse of authority.
Previously I posted that the FBI has been misusing National Security Letters. EFF shares their findings through a well thought out display of the documents provided by the Department of Justice, but only in response to the Federal Judge’s Order.

Jayci Yaeger is a 10 year old little girl dying from brain cancer. Her WISH: Have dad bedside as she leaves this life. PROBLEM: Jason Yaeger is a federal inmate housed at Yankton Federal Prison Camp. The Warden can approve a furlough for Jason to be with his daughter as she succumbs, but has refused according to news reports. Jason Yaeger was convicted of methamphetamine charges nearly five years ago and is scheduled to be released next year. Yes, NEXT YEAR. He’s scheduled to move to a half-way house in August 2008, but Jayci’s doctors fear it will be too late.

California State Senator Carole Migden was just fined $350,000.00 for her numerous violations of the Political Reform Act. You may remember Senator Migden as the “crazy driver” on Interstate 80 who was driving erratically and crashed into another car and didn’t take the time to assess the other party. Multiple calls to CHP via cellular telephones reported Migden as driving all over the place, including scraping the guardrail on at least two occasions. Did the tax payers have to pay to repair Migden’s state vehicle? Should we request the records to find out? There was a large question of whether Migden was on her cellphone at the time and I proposed using the Legislative Records Act to obtain the call history and usage times.

The Central Intelligence Agency is supposedly a “civilian” intelligence agency. Why then is the director General Michael V. Hayden, USAF?
The Central Intelligence Agency (CIA) was created in 1947 with the signing of the National Security Act by President Harry S. Truman. The act also created a Director of Central Intelligence (DCI) to serve as head of the United States intelligence community; act as the principal adviser to the President for intelligence matters related to the national security; and serve as head of the Central Intelligence Agency. The Intelligence Reform and Terrorism Prevention Act of 2004 amended the National Security Act to provide for a Director of National Intelligence who would assume some of the roles formerly fulfilled by the DCI, with a separate Director of the Central Intelligence Agency.

Why Bernie? Why violate the terms? Oh, let me guess, RESEARCH. It’s actually pretty odd to me that after being charged with receiving and transmitting child pornography and the chats between him and his online mistress he’s still allowed to have contact with his children? How much contact? Physical contact? I can’t think of any other case where a perp claims in a chat message to have “sucked” his own son and when Indicted and on house arrest he still has contact? What strings does he get to pull? Maybe it’s because he used to work for a well known senator. Hmmm.
